US Dept of Justice files lawsuit against sidewalk counselor one yr. after misdemeanor is dismissed??

Update:
Reporter answered my email and stated he has not heard back from the Dept of Justice on why they filed the lawsuit....and he further states that Mr. Hamilton now lives in Houston so he should not have trouble staying 8 feet away from the entrance.....which further makes me wonder why the Dept. choose to file a lawsuit against a dismissed misdemeanor when the clinic director disavows any knowledge of it?   Now why is the DOJ wasting our tax money chasing this??

Story in Louisville Courier Journal stating a man is being charged by the US Dept. of Justice for sidewalk counseling in front of the only abortion mill in Louisville under the Freedom of  Access to Clinic Entrance Act at EMW Women's Surgical Center.
Okay, I read this story and I am puzzled.....if  this incident happened in January as reported, I presume they are talking about January, 2010?  If the clinic director knew nothing of the lawsuit filed by the US Dept. of Justice who brought it to their attention since the case had been settled as a misdemeanor and Hamilton did community service work to settle this matter? I looked up the abortion mill and the web page showed no picture of the building so I looked at the Google map and it appears that customers have to park on the street to access the building and so anyone on the street could speak to them. I guess that is why they have escorts.  So if the lawsuit is successful he is to stay 8 feet away from anyone accessing  the building which is on a public street. I guess he would have to cross Market street when he got close to the building and then continue walking down the street on the other side? What if he wanted to access the business next door?  What if someone was parking across the street? The lawsuit if successful enacts a heavy fine of 15,000 penalty and $5,000 in compensatory damages.  Who is that paid to....EMW....the govt....the escort ? I have a call in to the reporter to see if he asked those questions and got any answers. BTW the first complaint which was dismissed as a misdemeanor was from an escort who accused him of shoving her. Hamilton claimed he was walking and talking to a woman and the moved the arm of an escort who was blocking access to her.   Per Hamilton's atty.the security guard saw the reaction of the escort not the incident and charged him. Lots of questions here....
EMW was caught on tape by Live Action.org giving misleading and inaccurate medical  information to a girl posing as  a 14 yr. old pregnant from a 31 yr. old and  failed to fulfill the requirements of the law mandating reports of sexual abuse which this is considered (rape in the third degree) not to mention counseling the girl as to the danger of her situation. No the counselor tells her there is a friendly lawyer that can get her a bypass to avoid  the legality of parental consent even though the girl gave no indication of  parental abuse. Click here to watch two unedited videos. Where is the legal action for these violations??
