Over a year later no action on abortionist brandishing gun at peaceful pro lifers during vigil....

40 Days for Life has just ended and in Nashville  it was  in front of the Women's Center. This place  is one of the most notorious abortion facilities that remains unlicensed, unregulated and uninspected.  Gary Boyle and wife have partial ownership of  three abortion mills,  Bristol, Nashville and Charleston, SC. He was known for successfully suing the TN Dept of Health when they tried to enforce a law that the abortion mills meet the same standards  as other outpatient surgery centers.

I remembered that Boyle had been  arrested in Charleston, SC on 10/2/2010 for brandishing a gun at two adults and one minor who were on the public sidewalk participating in 40 Days.
"According to news reports, Dr. Boyle was arrested October 2 after pointing a loaded gun at pro-life protesters participating in a peaceful vigil in front of his Charleston abortion facility. The handgun held 15 rounds and Dr. Boyle was charged by local police for having illegally pointed the weapon at peaceful protesters.
The incident is similar to one documented by Nashville pro-life advocates earlier this year in which Boyle, brandishing a handgun, got out of his car to confront a pro-life supporter outside The Women’s Center."

I have also followed news reports on how the Obama DOJ was cracking down with a ferociousness on people exercising their right to peaceful protest in front of abortion facilities. In one such case  the court threw out the case and chastised  the Obama DOJ with conspiracy at the highest levels with abortion facilities.
After 18 months of litigation, the DOJ’s case was thrown out of federal court, and the department was chastised for filing a case with no evidence. Federal Judge Kenneth L. Ryskamp stated that Holder’s complete failure to present any evidence of wrongdoing, coupled with the DOJ’s cozy relationship with PWC and their joint failure to preserve video surveillance footage of the alleged “obstruction,” caused the court to suspect a conspiracy at the highest level of the Obama Administration. “The Court is at a loss as to why the Government chose to prosecute this particular case in the first place,” wrote Judge Ryskamp. “The Court can only wonder whether this action was the product of a concerted effort between the Government and PWC, which began well before the date of the incident at issue, to quell Ms. Pine’s activities rather than to vindicate the rights of those allegedly aggrieved by Ms. Pine’s conduct.”
After this ruling the DOJ appealed on the last day possible and gave indication that President Obama ordered the appeal.
While two cases have ended well for the sidewalk counselors and the prayer vigil people there are six more still pending.

So I got to wondering what is happening with the man who brandished a loaded gun at the pro life vigil participants  in Charleston. After his arrest in 10/ 2010, he was promptly released on a $25,000 bond and in January of 2011  his atty appeared on his behalf and the case was continued.

I looked up online and saw that no action following the continuation of over a year ago. I called the office of the Solicitor General, Scarlett Wilson and was promptly handed off to a Press Secretary, Naomi Nation who could give no information of when any further action would be forthcoming referring me instead to a website that tells of upcoming trials. I asked the press secretary  for Solicitor Scarlett Wilson to call me on this question and I await her call on this matter.

I hope the  ferociousness of prosecution is not a one way street.

Abortionist who brandished gun at 40 Day for Life people bound over after preliminary hearing

Boyle  is the owner of the Women's Center in Nashville  the abortion mill mentioned in the article...he also performs his services there 4 days per week.

from Life News.com
The abortion practitioner who brandished a gun when heading to do abortions at the Charleston  Women’s Medical Center abortion facility in West Ashley, South Carolina in October is headed to trial.
Charleston County Associate Chief Magistrate James B. Gosnell Jr. issued a ruling at a preliminary hearing today that enough evidence exists for the case against Gary Boyle, 62, of Blountville, Tennessee, to move forward. Boyle lives in Tennessee but does abortions at the facility near Charleston.
Apparently upset at the fact that local pro-life advocates had been participating in the national 40 Days for Life campaign, Boyle met their peaceful presence by pulling a gun.
Boyle drove his silver Lexus vehicle into the parking lot and he allegedly approached the pro-life advocates, including a 17-year-old boy, and produced a black handgun loaded with 15 rounds. As Boyle, who also runs the Bristol Regional Women’s Center abortion facility in Tennessee, made his way to the abortion business, 50-year-old pro-life resident John Karafa called 911.
Police arrested Boyle and charged him with pointing a firearm.
According to the Post and Courier newspaper, a police detective said in court today that Boyle, during an interview with police officials, admitted to having a weapon but claimed he pointed it at the ceiling of his SUV and not at any of the pro-life advocates. Boyle told officers he was worried for his life even though pro-life advocates did not threaten him in any way and claimed three pro-life people approached his vehicle. The people at the abortion center that day dispute that claim.
Boyle is officially charged with presenting a firearm, a felony that could see him face as many as five years in prison if convicted and sentenced to the maximum term.
Boyle reportedly holds a Tennessee permit to carry the gun, and the state has a reciprocal agreement with South Carolina to allow weapons to be carried that are eligible in Tennessee. He has already been freed on $25,000 bond.
Last October, 50-year-old pro-life resident John Karafa called 911 after seeing the gun Boyle brandished.
“We were like, ‘Well, that was a gun,’” Karafa told the newspaper. “You can’t do that.”
Several of the local pro-life prayer event participants, who had signed pledges stating they would act in a peaceful, nonviolent manner during the 40 Days for Life event, appeared outside the courthouse while the booking took place.
Local resident Sandra Rochester said Boyle must have been wanting to intimidate the pro-life people who have been handling out literature for women showing abortion alternatives.
“We’ve saved four babies so far,” Rochester told the newspaper.
Boyle has had legal problems before as he and his business partner ran in trouble in Tennessee because they did not have the proper papers from the state to run their abortion business. The health department tried to close the abortion center, but a state judge eventually ruled the paperwork requirement was unconstitutional.
Boyle’s arrest came two months after a man was arrested outside a late-term abortion facility in New Mexico after he threatened to shoot two pro-life women providing alternatives to women going to the Southwestern Women’s Options abortion center. The abortion center is operated by late-term abortion practitioner Curtis Boyd.
The man reportedly became angry and ushered his family towards the abortion clinic.
“When we come out, I’m going to put a bullet in your head if you talk to her,” the man told the pro-life women, whose identities pro-life advocates are withholding to protect their security.
Former Operation Rescue intern Bud Shaver said the man then lifted his shirt to reveal a dark object to the two pro-life women that they described as looking like a gun. The women called police who, Shaver said, “responded appropriately and took him away in handcuffs.”
Shaver said the man’s threat had the opposite effect of allowing abortions as a police SWAT team arrived and shut down the abortion center for two hours, preventing abortions from taking place.

Update: Boyle in Nashville instead of hearing......Hearing set for dr. who flashed gun at 40 Days for Life prayer vigil ......runs abortion mills in TN and SC

Update: Thursday, January 13, 2011.....so where is the good dr. right now when he is supposed to be at his preliminary hearing in Charleston SC????? Where's Gary...prayer advocates report that he is at his Nashville abortion facility  on Welshwood  at the  time of his reported hearing in South Carolina. Reporter in SC reports that the hearing was continued.....Boyle is a busy man don't you know.

Hearing is set for tomorrow for the dr. who flashed a gun at  the 40 Days for Life people doing a prayer vigil in front of his abortion mill in Charleston SC. We have written about him before here and here. This is the dr. who runs abortion mills in TN and SC and has been in trouble with the law in the past. Although MSM like to portray the people on the public sidewalk outside his clinics as protesters, they actually were peaceful law abiding people praying for 40 Days for Life. Of course many see prayers as being a dangerous  thing as in watch that lady, she is holding a rosary in her hands...
Pix above is the Women's Center in Nashville...one of the most notorious abortion mills he owns.
He got into a scrape with the law with this mill for operating without a required certificate of need from the Health Dept. The Health Dept. attempted to shut them down but with the liberal judges and ACLU he is still in business there he is up and running as a judge ruled that to make him abide by the rules other ambulatory surgical treatment centers do is a violation of a woman's right to privacy.
